Vannak olyan kolleg\u00e1k, akiknek v\u00e1ltoz\u00f3 a m\u0171szakbeoszt\u00e1suk, \u00e9s vannak olyanok is, akik p\u00e9ld\u00e1ul csak a d\u00e9lut\u00e1ni m\u0171szakban dolgoznak. A munk\u00e1ltat\u00f3 nem minden m\u0171szakban dolgoz\u00f3 munkav\u00e1llal\u00f3nak fizet m\u0171szakp\u00f3tl\u00e9kot. Ezt azzal magyar\u00e1zt\u00e1k, hogy a t\u00f6bb m\u0171szakos munkarend ellen\u00e9re nem minden munkav\u00e1llal\u00f3 eset\u00e9ben \u00e1llnak fenn a m\u0171szakp\u00f3tl\u00e9kra vonatkoz\u00f3 t\u00f6rv\u00e9nyi felt\u00e9telek. Milyen esetekben j\u00e1r a m\u0171szakban dolgoz\u00f3 munkav\u00e1llal\u00f3nak m\u0171szakp\u00f3tl\u00e9k?<\/strong><!--more--><\/p>\n<p style=\"text-align: justify;\">A m\u0171szakp\u00f3tl\u00e9kra val\u00f3 jogosults\u00e1gnak nem felt\u00e9tele, hogy a munk\u00e1ltat\u00f3 a munkav\u00e1llal\u00f3t t\u00f6bb m\u0171szakos munkarendben foglalkoztassa, ugyanis a p\u00f3tl\u00e9kra val\u00f3 jogosults\u00e1g nem a munk\u00e1ltat\u00f3 tev\u00e9kenys\u00e9g\u00e9vel, hanem els\u0151dlegesen a munkav\u00e1llal\u00f3 munkaid\u0151-beoszt\u00e1s\u00e1val \u00e1ll \u00f6sszef\u00fcgg\u00e9sben. A munkav\u00e1llal\u00f3 akkor jogosult m\u0171szakp\u00f3tl\u00e9kra, ha<\/p>\n<ol style=\"text-align: justify; list-style-type: lower-alpha;\">\n<li>a beoszt\u00e1s szerinti napi munkaid\u0151 kezdete rendszeresen v\u00e1ltozik, valamint<\/li>\n<li>a munkav\u00e9gz\u00e9sre 18:00 \u2013 6:00 \u00f3ra k\u00f6z\u00f6tt (m\u0171szakp\u00f3tl\u00e9kra jogos\u00edt\u00f3 id\u0151szak) ker\u00fcl sor.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">A beoszt\u00e1s szerinti napi munkaid\u0151 kezdet\u00e9nek v\u00e1ltoz\u00e1s\u00e1t akkor kell rendszeresnek tekinteni, ha havonta a beoszt\u00e1s szerinti napi munkaid\u0151 kezdet\u00e9nek id\u0151pontja a munkanapok legal\u00e1bb egyharmada eset\u00e9ben elt\u00e9r, valamint a legkor\u00e1bbi \u00e9s a legk\u00e9s\u0151bbi kezd\u00e9si id\u0151pont k\u00f6z\u00f6tt legal\u00e1bb n\u00e9gy \u00f3ra elt\u00e9r\u00e9s van.<\/p>\n<p style=\"text-align: justify;\">Ez teh\u00e1t azt jelenti, hogy ha p\u00e9ld\u00e1ul<\/p>\n<ol style=\"text-align: justify; list-style-type: lower-alpha;\">\n<li>az adott h\u00f3napban 20 munkanap van,<\/li>\n<li>a beoszt\u00e1s szerinti napi munkaid\u0151 kezdet\u00e9nek id\u0151pontja legal\u00e1bb h\u00e9t munkanapon elt\u00e9r,<\/li>\n<li>ez alatt a h\u00e9t munkanap alatt legal\u00e1bb egy alkalommal a legkor\u00e1bbi \u00e9s a legk\u00e9s\u0151bbi kezd\u00e9si id\u0151pont k\u00f6z\u00f6tt legal\u00e1bb n\u00e9gy \u00f3ra elt\u00e9r\u00e9s van, valamint<\/li>\n<li>a munkav\u00e9gz\u00e9sre 18:00 \u2013 6:00 \u00f3ra k\u00f6z\u00f6tt (m\u0171szakp\u00f3tl\u00e9kra jogos\u00edt\u00f3 id\u0151szak) ker\u00fcl sor<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">a munkav\u00e1llal\u00f3nak j\u00e1r a m\u0171szakp\u00f3tl\u00e9k.<\/p>\n<p style=\"text-align: justify;\">A 2012-es Munka T\u00f6rv\u00e9nyk\u00f6nyv\u00e9nek hat\u00e1lyba l\u00e9p\u00e9se ut\u00e1n jog\u00e9rtelmez\u00e9si vita alakult ki ak\u00f6r\u00fcl, hogy az egyharmad id\u0151n bel\u00fcl h\u00e1ny alkalommal kell a legkor\u00e1bbi \u00e9s a legk\u00e9s\u0151bbi kezd\u00e9si id\u0151pont k\u00f6z\u00f6tt legal\u00e1bb n\u00e9gy \u00f3r\u00e1nak eltelnie. A K\u00faria a 11\/2019. sz\u00e1m\u00fa munka\u00fcgyi elvi hat\u00e1rozat\u00e1ban [K\u00faria Mfv. III. 10.206\/2018\/4] pontot tett a jog\u00e9rtelmez\u00e9si vita v\u00e9g\u00e9re \u00e9s kifejtette, hogy nincs jelent\u0151s\u00e9ge annak, hogy az adott h\u00f3napban meg\u00e1llap\u00edthat\u00f3 legkor\u00e1bbi \u00e9s legk\u00e9s\u0151bbi id\u0151pont egy\u00e9bk\u00e9nt h\u00e1ny munkanapon val\u00f3sul meg, mivel az el\u0151fordul\u00e1s gyakoris\u00e1g\u00e1ra nincs k\u00f6vetelm\u00e9ny a jogszab\u00e1ly sz\u00f6veg\u00e9ben. Amennyiben a jogalkot\u00f3 csak az egyharmad id\u0151n bel\u00fcli n\u00e9gy\u00f3r\u00e1s elt\u00e9r\u00e9st k\u00edv\u00e1nta volna b\u00e9rp\u00f3tl\u00e9kkal ellent\u00e9telezni, \u00fagy ennek megfelel\u0151en kellett volna a jogszab\u00e1ly sz\u00f6veg\u00e9t alak\u00edtania. Vagyis elegend\u0151, hogy a legkor\u00e1bbi \u00e9s a legk\u00e9s\u0151bbi kezd\u00e9si id\u0151pont k\u00f6z\u00f6tt legal\u00e1bb n\u00e9gy \u00f3r\u00e1s elt\u00e9r\u00e9s legal\u00e1bb egy munkanapon \u00e1ll fenn.<\/p>\n<p style=\"text-align: justify;\">Nem illeti meg viszont m\u0171szakp\u00f3tl\u00e9k a munkav\u00e1llal\u00f3t, ha a munk\u00e1ltat\u00f3 b\u00e1r t\u00f6bb m\u0171szakos munkarendet alkalmaz, de a munkav\u00e1llal\u00f3 munkaid\u0151-beoszt\u00e1sa \u00e1lland\u00f3 (pl. csak d\u00e9lut\u00e1ni m\u0171szakban dolgozik) vagy a munkav\u00e1llal\u00f3 nem a m\u0171szakp\u00f3tl\u00e9kra jogos\u00edt\u00f3 id\u0151szakban (18:00 \u2013 6:00 \u00f3ra k\u00f6z\u00f6tt) v\u00e9gez munk\u00e1t.
